Fox v. Vice

Ricky Fox ran against incumbent Billy Ray Vice for chief of police in Vinton, Louisiana. Vice allegedly engaged in various improper campaign tactics including sending anonymous threatening letters to Fox, arranging for a third party to publicly accuse Fox of using racial slurs, filing a false criminal complaint against Fox, and leaking the complaint to the press when prosecutors ignored it. Despite these tactics, Fox won the election, and Vice was subsequently convicted of criminal extortion for his election-related conduct. Fox then filed suit in Louisiana state court asserting both state-law claims such as defamation and federal civil rights claims under 42 U.S.C. § 1983 for interference with his right to seek public office. Vice removed the case to federal court based on the federal claims. After discovery, Vice moved for summary judgment on the federal claims, which Fox conceded were not valid. The District Court dismissed the federal claims with prejudice, declined to exercise supplemental jurisdiction over the state-law claims, and remanded those claims to state court for adjudication.
