Flood v. Kuhn
Citation:
407 U.S. 258 (1972)Facts
Curtis Charles Flood began his major league career in 1956 with the Cincinnati Reds and was traded to the St. Louis Cardinals before the 1958 season. Over twelve seasons with the Cardinals, he compiled a .293 batting average, participated in three World Series, and received seven Golden Glove Awards. In October 1969, at age 31, Flood was traded to the Philadelphia Phillies without his consultation or consent. In December 1969, he wrote to the Commissioner of Baseball requesting to be made a free agent with the right to negotiate with any team, but his request was denied. Flood then filed this antitrust suit in January 1970, challenging baseball’s reserve system, which bound players to their original teams unless traded or released. He refused to play for Philadelphia in 1970 despite a $100,000 salary offer. After Philadelphia sold its rights to Flood to the Washington Senators, he briefly played for them in 1971 at a salary of $110,000 but left early in the season and never played professional baseball again.
