Facts
The plaintiff was an employee of NASA and was attending a business luncheon near Houston, Texas on the day of the events in question. As the plaintiff was standing in line for lunch, he was approached by an employee of the hotel hosting the event. The employee proceeded to snatch the plate from the plaintiff’s hands, and tell him that because he was black, he could not be served lunch at this hotel. The plaintiff testified that while he was not touched, the conduct of the employee was deeply offensive, espesically given that it happened in front of his colleagues.
