Fera v. Village Plaza Inc.
Citation:396 Mich. 639, 242 N.W.2d 372 (1976).
Village Plaza was building a shopping center when plaintiffs executed a ten-year lease for its “book and bottle” shop. The proposed business would be a book shop that also sold alcohol. Complications arose during construction and Village Plaza defaulted on its loan obligations. The Bank of the Commonwealth received the deed to the shopping center in lieu of the foreclosing on Village Plaza. After construction was completed, the plaintiffs were refused their space in the shopping center because their lease had been misplaced and the space was rented to a different tenant. An alternative space was offered, but refused because it was not suitable for the business.
