C. Elvin Feltner owned Krypton International Corporation, which in 1990 acquired three television stations in the southeastern United States. Columbia Pictures Television had licensed several television series to these stations. After the stations became delinquent in royalty payments, negotiations to restructure the debt failed, and Columbia terminated the license agreements in October 1991. Despite the termination, Feltner’s stations continued broadcasting Columbia’s programs. Columbia sued for copyright infringement seeking various remedies including statutory damages. The District Court granted partial summary judgment on liability and denied Feltner’s jury trial request. After a bench trial, the judge found 440 acts of willful infringement and awarded $8,800,000 in statutory damages at $20,000 per infringement.
