Anna Sacks Feinberg began working for Pfeiffer Co., a pharmaceutical manufacturer, in 1910 when she was 17 years old. By 1947, she had risen to the position of bookkeeper, office manager, and assistant treasurer. On December 27, 1947, the Board of Directors adopted a resolution granting Feinberg a $50 monthly raise and the privilege of retiring at any time with a pension of $200 per month for life. The resolution acknowledged her “many years of long and faithful service” and exceptional ability. Feinberg was informed of this resolution the same day and continued working until June 30, 1949, when she retired at age 57. The company paid her the promised $200 monthly pension until April 1956, when a new company president unilaterally reduced the payment to $100 per month, claiming the payments were mere gratuities rather than contractual obligations. Feinberg refused to accept the reduced amount and filed suit. At the time of trial, she was 65 years old and unable to work due to health issues.
