Fauntleroy v. Lum

Defendant, Lum, owed a debt to Plaintiff, Fauntleroy, due to a gambling transaction in cotton futures that occurred in Mississippi. Lum declined to pay the loss, and the issue was submitted to arbitration. The issue of the legality of the gambling transaction was not included in the submission for arbitration. An award was rendered against Lum.
After finding that Lum was in Missouri, Fauntleroy brought suit in Missouri state court to enforce the judgment against Lum. Lum argued that the gambling transaction was illegal under Mississippi law. The Missouri court had personal jurisdiction over Lum and found in favor of Fauntleroy. Lum brought an appeal before the Mississippi Supreme Court, which found in favor of Lum. Fauntleroy appealed.
