Frank and Rosamaría Rees married in 1997 and each obtained life insurance policies from Farmers with $150,000 in benefits, naming each other as sole beneficiaries with no contingent beneficiaries. On September 18, 2009, Rosamaría was shot and killed in the street outside their home. The Los Angeles Police Department investigated her death as a homicide, and Frank was identified as a suspect, at one point described as a “prime suspect.” Frank filed a claim for the policy benefits on October 14, 2009. Farmers repeatedly informed Frank that it would await the results of the police investigation before paying the claim. After Frank retained counsel who sent a letter requesting information and confirmation regarding the claim, Farmers decided to file an interpleader action. Farmers deposited $154,587 with the court and named Frank and later Rosamaría’s mother as defendants. Rosamaría’s mother defaulted, and the court ultimately awarded Frank the policy benefits less attorney fees and costs requested by Farmers.
