Contracts Keyed to Fuller
Farm Bureau Mutual Insurance Co. v. Sandbulte
Citation:
302 N.W.2d 104 (Iowa 1981)Facts
Kenneth Sandbulte farmed 760 acres across four separate tracts of land spread over approximately nine miles in Sioux County, Iowa. On April 22, 1976, his son Wendell drove a pickup truck approximately 8½ miles from the homeplace (northernmost tract) to the southernmost tract to plow. When he experienced problems with the tractor, he left it in the field and headed back to the homeplace in the pickup to get another tractor. Approximately halfway home, Wendell failed to yield the right-of-way at an intersection, and the pickup was struck by a motorcycle operated by Kenneth Vander Lugt, causing serious injuries. The accident occurred on county road K42, which adjoined two of Sandbulte’s tracts—one three-fourths mile north of the accident site and the other four miles south. Farm Bureau insured the pickup under a motor vehicle policy and tendered the maximum coverage under that policy to Vander Lugt. Farm Bureau also insured Sandbulte under a farm liability policy called Squire IV, which provided maximum coverage of $300,000 for bodily injury but excluded coverage for motor vehicles “while away from the insured premises or the ways immediately adjoining.”
