The Fallini family operated a cattle ranch in Nevada and held grazing permits for their cattle on public lands administered by the Bureau of Land Management (BLM). The Fallinis had developed water sources on these public lands for their cattle, investing significant resources in maintaining these water developments. Over time, wild horse populations in the area exceeded the BLM’s own determined Appropriate Management Level (AML). These excess horses consumed water from the Fallinis’ developed sources, which the ranchers claimed interfered with their water rights and caused economic harm to their ranching operations. Despite repeated requests from the Fallinis, the BLM failed to remove excess horses or prevent them from accessing the water sources.
