Raymond Victor Bethel entered into two contracts with Diesel “Repower,” Inc., a corporation whose president was Rex Thorn. The first contract involved Bethel’s purchase of a marine engine and transmission, and the second involved his purchase of three generators. Bethel paid in full for all items but claimed he never received the engine, transmission, or any of the generators. After initially suing Diesel and Rex Thorn for breach of contract, fraud, fraudulent suppression, and negligence, Bethel’s fraud claims against Thorn individually were reinstated on appeal. Bethel then filed an amended complaint adding Martha Thorn and Thorn’s Diesel Service, Inc. as defendants, alleging that Diesel and its successor corporation Service were alter egos of Rex and Martha Thorn. Bethel requested a jury trial on all counts, including the piercing-the-corporate-veil theory.
