The Greens (defendants) signed a contract for the purpose of hiring Ever-Tite Roofing Corporation (“Ever-Tite”) (plaintiff) in the re-roofing of their home. The contract specified that it would becoming binding only upon either written acceptance or the commencement of performance of the work. After signing the agreement, Ever-Tite had to obtain credit reports and contact the lending institution that would finance the credit. The day immediately following the credit approval, Ever-Tite had its workmen and two trucks proceed to the Greens’ residence to begin the re-roofing. When Ever-Tite arrived at the Greens’ home, they found out that another contractor service had already been hired to perform the work. Ever-Tite brought suit against the Greens.
