The parties married in 1937 and lived together in New York until 1942 when Mr. Estin abandoned Mrs. Estin. In 1943, Mrs. Estin brought a separation action in New York. Mr. Estin entered a general appearance, and the court granted a separation decree awarding her $180 per month as permanent alimony. In January 1944, Mr. Estin moved to Nevada and in 1945 instituted divorce proceedings. Mrs. Estin received only constructive service through publication and entered no appearance. The Nevada court granted an absolute divorce based on three years’ continuous separation, making no provision for alimony despite being advised of the New York decree. Mr. Estin had made alimony payments under the New York decree but ceased after obtaining the Nevada divorce. Mrs. Estin then sued in New York for arrears.
