Conflict of Laws Keyed to Hay, 16th Ed.
Estate of Hanreddy
Citation:
176 Wis. 570, 186 N.W. 744 (1922)Facts
Joseph Hanreddy, a resident of Chicago, Illinois, died testate on April 8, 1918. His widow, Margaret Hanreddy, was appointed executrix in the probate court of Cook County, Illinois, where claims exceeding fifty thousand dollars were filed against available assets of only four thousand dollars. In August 1918, ancillary administration was commenced in Milwaukee County, Wisconsin, where assets exceeded fifty thousand dollars and both resident and nonresident creditors filed claims totaling more than the available Wisconsin assets. The executrix petitioned the Wisconsin court to treat all assets in both jurisdictions as one fund for pro rata distribution to all creditors, noting that if Wisconsin assets were distributed only to Wisconsin claimants, they would receive approximately ninety percent of their claims while Illinois claimants would receive only ten percent, creating an inequitable result.
