Estate of Dow
Citation:
174 N.H. 37, 260 A.3d 1 (2021)Facts
Marie G. Dow executed her last will and testament on June 30, 2014. She was survived by her son Christopher Dow, her ex-daughter-in-law Leslie Dow, another son, and her granddaughter. The will outlines several key provisions regarding the distribution of her estate.
In Article Second, Marie bequeaths the rest of her estate—referred to as her “residuary estate”—to her daughter-in-law, Leslie Dow. However, if Leslie does not survive Marie, the estate is to be passed on to Marie’s granddaughter.
Article Eighth explicitly states that Marie intentionally omitted any mention of other individuals or beneficiaries in her will, affirming that no one other than those named in the will is entitled to any portion of her estate.
Finally, Article Ninth specifies that the administration and enforcement of her estate should be carried out in accordance with the laws of the Commonwealth of Massachusetts.
