Esquivel-Quintana (Petitioner) was a native and citizen of Mexico, who was admitted to U.S. as a lawful permanent resident in 2000. In 2009, he was ordered removed to Mexico on the basis of a statutory rape offense. Under the requirements of the Immigration and Nationality Act (INA), any alien who is convicted of an aggravated felony after admission to the U.S. may be removed from the country. On appeal to the Supreme Court, Esquivel-Quintana argued that his offense did not constitute sexual abuse of a minor under the INA, and was therefore not a removable offense.
