Plaintiffs contracted with Defendant to build their home, and Plaintiffs moved into their house Dec. 1990. In February 1991, the house leaked from every location. Defendant was ineffective in his attempts to stop the leaks. Despite several efforts, the house continued to leak from every location. Plaintiffs had their home inspected by another general contractor and structural engineer. The inspection confirmed defects in the home and serious errors in the construction of the home’s structural components. According to Plaintiffs’ expert, problems were significant and pervasive; concerning everything related to a window or waterproofing, everywhere there was something related to framing. Additionally, Plaintiffs testified to suffering emotional distress with Barry having to be taken in an ambulance to the hospital.
