On January 19, 2005, near Geneseo, New York, a charter bus operated by Erie Coach Lines Company and carrying members of an Ontario women’s hockey team collided with a tractor-trailer owned by Pennsylvania-based J&J Trucking that was parked on the highway shoulder. The accident resulted in the deaths of three bus passengers and the tractor-trailer driver, Ernest Zeiset, and caused serious injuries to several other bus passengers. All injured and deceased passengers were Ontario domiciliaries, as were the bus driver, his employer, and the bus leasing company. The tractor-trailer driver, his employer, and related companies were Pennsylvania domiciliaries. Multiple wrongful death and personal injury lawsuits were filed in New York Supreme Court. The critical legal issue involved whether Ontario’s statutory cap on noneconomic damages for catastrophic injuries would apply, or whether New York’s unlimited damages rule would govern the recovery.
