Drayton v. Jiffee Chemical Corp.
Citation:
395 F. Supp. 1081 (1975)Facts
On December 21, 1968, James Henderson, the father of one-year-old Terri Drayton, obtained a bottle of Liquid-Plumr from his landlady to unclog a bathroom sink. Henderson carried Terri upstairs, placed her in the hallway, and entered the bathroom. He poured half the bottle into the drain and placed the uncapped bottle on the back of the sink. Henderson then covered the drain with a towel. At that moment, Terri entered the bathroom, grabbed his leg, and screamed. The bottle had fallen and spilled its contents onto Terri’s face, causing immediate chemical burns. Terri was taken to the hospital but suffered severe and permanent disfigurement. The product, Liquid-Plumr, contained 26% sodium hydroxide (lye), which causes rapid destruction of human tissue through saponification. As a result of her injuries, Terri underwent eleven surgeries, experienced severe physical and psychological trauma, and faced permanent disfigurement and emotional distress. Expert testimony established that the high concentration of sodium hydroxide made the product unreasonably dangerous for household use.
