Contracts Keyed to Dawson
Doyle v. S. Pittsburgh Water Co.
Citation:
414 Pa. 199 (1964)Facts
The plaintiff, Doyle, owned a home that was destroyed by fire. The South Pittsburgh Water Company had a contract with the municipality to provide water service, including maintaining adequate water pressure for firefighting purposes. When a fire broke out at Doyle’s home, the fire department responded but allegedly could not effectively fight the fire due to inadequate water pressure from the hydrants maintained by the defendant water company. Doyle sued the water company for breach of contract, claiming to be a third-party beneficiary of the contract between the water company and the municipality. Doyle argued that the contract was intended to benefit residents like himself by providing fire protection, and therefore he had standing to sue for breach of that contract.
