Plaintiffs John Doe, a minor, and his parents Jack and Jane Doe filed suit challenging New Jersey’s Assembly Bill A3371, which prohibits state-licensed mental health professionals from providing Sexual Orientation Change Efforts therapy to minors. The statute was enacted based on legislative findings that SOCE is potentially harmful and ineffective. John Doe desired to undergo SOCE therapy to address same-sex attractions, and his parents supported this decision based on their sincerely held religious beliefs. However, A3371 prevented them from obtaining such therapy from licensed professionals in New Jersey. Plaintiffs argued the statute violated their First Amendment rights to receive information and freely exercise their religion, as well as the parents’ Fourteenth Amendment right to direct their child’s upbringing and medical care. The case followed similar litigation in King v. Christie, where therapists challenged the same statute.
