In 2009, 89-year-old Bucilla Stephenson executed an advance directive designating her granddaughter Jacqueline Alicea as her healthcare agent, specifically indicating she did not want her life prolonged if she had an incurable and irreversible condition. In March 2012, Stephenson was admitted to Doctors Hospital with pneumonia, sepsis, and acute renal failure. Alicea provided the hospital with the advance directive and specifically instructed Dr. Catalano and other physicians that no heroic measures should be used and that she must be called before any intubation. On March 7, 2012, when Stephenson experienced respiratory distress, Dr. Catalano ordered her intubation without consulting Alicea, despite a nurse suggesting he call her first. Dr. Catalano rebuffed this suggestion, stating he would call Alicea later “and tell her what happened.” Stephenson remained on life support for ten more days before being removed from the ventilator, after which she died three days later.
