On December 27, 1998, Rebecca DiSorbo and her sister Jessica went to the Union Inn Bar in Schenectady, New York. Off-duty Officer Ronald Pedersen approached Rebecca and made personal advances, asking about her boyfriend. When Rebecca rebuffed him, Pedersen demanded identification and forcibly arrested her, twisting her arm behind her back. Jessica was also arrested after allegedly dropping a beer glass. At the police station, while handcuffed and defenseless, Rebecca was allegedly choked by Pedersen until she lost vision, slammed against walls, thrown to the ground, and repeatedly struck. She suffered extensive bruising, two large hematomas on her head, and significant psychological trauma. Jessica alleged she was slammed into a door and dragged through the station. Medical examination documented numerous bruises throughout Rebecca’s upper body, though no permanent scarring or nerve damage resulted.
