Defendant Dodds signed and delivered a memorandum to Plaintiff, offering to sell him an estate. The letter kept the offer open until June 12 at 9am. Plaintiff delivered acceptance to Defendant Dodds’ mother-in-law on the 11th and provided a copy of that acceptance to Defendant Dodds on June 12 at 7am. Defendant Dodds, however, had already sold the estate to Defendant Allen. Plaintiff filed suit for specific performance, asking for the land to be conveyed to him.
