Dodds was selling his property. Dickinson wanted to buy the property. On June 10th, Dodds delivered to Dickinson a document offering to sell the property, which included a clause stating the offer would stay open until 9 am on June 12th. On June 11th, Dickinson heard that Dodds had offered and sold the property to Allan. Afterwards, Dodds left a written acceptance to the offer at the home where Dickinson was staying, but that acceptance was never delivered. On June 12th, before 9 am, Dickinson met Dodds and gave him a written acceptance of the offer. Dodds refused to accept, as he had already sold the property to Allan. Dickinson then sued Allan and Dodds.
