Dickens (Plaintiff), a thirty-one year old man, shared sex, alcohol, and marijuana with a seventeen year old high school student. The high school student’s father, Puryear (Defendant), and four other men, handcuffed the Plaintiff and beat him with nightsticks and openly deliberated castrating or killing him. The Defendant ultimately let the Plaintiff go with instructions to leave the state or be killed. Plaintiff brought a lawsuit for intentional infliction of emotional distress more than one year but less than three years after the incident.
