Antonio DeSpirito’s cellar flooded with approximately eighteen inches of water after a drainpipe running from his residence foundation to the street was broken by employees of Bristol County Water Company. Despite DeSpirito’s warning to the employees, they failed to exercise due care while excavating in the area where the drainpipe was laid. The break prevented ground and surface water from draining properly, causing it to saturate the area surrounding the residence and seep into the cellar. The flooding continued for ten days until the drainpipe was repaired, during which time water damaged the residence itself as well as various household goods and personal effects including a washing machine, sump pump, and heating unit. DeSpirito brought this negligence action to recover the costs and expenses incurred in repairing and replacing the damaged property.
