489 U.S. 189Facts
Joshua was born and a year later, his parents divorced and courts gave custody of Joshua to his father. The father shortly thereafter moved with the infant and entered into a second marriage, which also ended in divorce. Joshua was regularly subjected to child abuse by his father, to which the authorities were alerted numerous times. At four years old, Joshua was so severely beaten by his father that he fell into a life-threatening coma that required emergency brain surgery which revealed a series of hemorrhages caused by traumatic injuries to the head inflicted over a long period of time. He has now suffered severe brain damages because of which he is confined to an institution. His father was subsequently tried and convicted for child abuse.
