Georgia-Pacific West and other logging companies had contracts with the State of Oregon to harvest timber from Tillamook State Forest. The companies used logging roads for timber harvesting operations. During rainfall, water ran off these graded roads into a system of ditches, culverts, and channels that discharged the water into nearby rivers and streams. These discharges contained large amounts of sediment in the form of dirt and crushed gravel, which evidence showed could harm fish and other aquatic organisms. The companies had not obtained NPDES permits for these discharges. Oregon had implemented comprehensive best management practices to control stormwater runoff from logging roads, including rules mandating filtration of stormwater before it enters waterways and requiring specific road construction techniques to minimize sediment in runoff.
