Davidow v. Inwood North Professional Group-Phase I
Citation:
747 S.W.2d 373 (Tex. 1988)Facts
Dr. Davidow entered into a five-year lease agreement with Inwood for medical office space at $793.26 per month. The lease required Inwood to provide air conditioning, electricity, hot water, janitorial and maintenance services, light fixtures, and security services. Shortly after moving in, Dr. Davidow experienced numerous problems: malfunctioning air conditioning causing temperatures above 85 degrees, roof leaks resulting in stained tiles and rotting carpet, pest and rodent infestations, dark hallways due to unreplaced lights, lack of cleaning and maintenance, trash-filled parking lot, no hot water, and occasional power outages. The office also experienced burglaries and vandalism. After enduring these conditions, Dr. Davidow vacated the premises approximately fourteen months before the lease expired and stopped paying rent.
