Dandeneau v. Seymour

In August 1972, the Dandeneaus entered into a written contract with Seymour to build a breezeway and garage attached to her house in North Sandwich, New Hampshire, in exchange for a parcel of land containing a sap house, valued at approximately $4,000. The Dandeneaus completed about 73% of the construction by early 1973 but then virtually abandoned the project. Instead, they focused on making the sap house livable, even clearing and selling timber from Seymour’s land without permission to finance these improvements. By 1975, the plaintiffs had accumulated substantial debt, and when one of their creditors attempted to attach Seymour’s property, she canceled the contract and ordered them to vacate. Upon eviction, the plaintiffs vandalized the sap house, cutting wires and pipes, plugging drains, and removing fixtures.
