Constitutional Law Keyed to Choper
Cutter v. Wilkinson
Citation:
544 U.S. 709 (2005)Facts
The petitioners were current and former inmates of institutions operated by the Ohio Department of Rehabilitation and Correction who identified as adherents of “nonmainstream” religions, including Satanism, Wicca, Asatru, and the Church of Jesus Christ Christian. They filed suit claiming that prison officials violated RLUIPA by failing to accommodate their religious exercise in various ways, including denying them access to religious literature, denying opportunities for group worship that were granted to mainstream religions, forbidding adherence to religious dress and appearance mandates, withholding religious ceremonial items, and failing to provide chaplains trained in their faiths. The prison officials stipulated that petitioners were members of bona fide religions and were sincere in their beliefs. However, they challenged RLUIPA’s constitutionality, arguing that the Act improperly advanced religion in violation of the Establishment Clause by giving special protection to religious rights over other constitutional rights.
