Curran v. Bosze
Citation:
566 N.E.2d 1319 (Ill. 1990)Facts
Nancy Curran and Tamas Bosze were never married but had 3½-year-old twins, Allison and James, who lived with Ms. Curran since birth. A February 1989 parentage order established Ms. Curran as sole custodian with authority over the twins’ healthcare. Mr. Bosze had limited visitation rights, exercised only fifteen times in one year. Jean Pierre Bosze, Mr. Bosze’s 12-year-old son from another relationship, suffered from acute undifferentiated leukemia and required a bone marrow transplant to survive. The twins had met Jean Pierre only twice, each meeting lasting approximately two hours, and were not told he was their half-brother per Ms. Curran’s request. After Jean Pierre’s father, mother, and older brother tested incompatible as donors, Mr. Bosze requested Ms. Curran consent to compatibility testing and potential bone marrow harvesting from the twins. Ms. Curran refused after consulting medical professionals, citing risks of general anesthesia and the invasive harvesting procedure requiring 100 bone punctures, combined with the absence of any relationship between the twins and Jean Pierre.
