David and Orilla Mae Cropp are self-employed truck drivers who reside in Gervais, Oregon, which is also their principal place of business. In 1990, they worked in Oregon, Washington, California, Nevada, and Arizona. On December 18, 1990, while returning to Oregon with a load of lime from Napa Valley, California, they pulled to the side of Highway 395 near Doyle, California, to change drivers. Robert Edward Rust, a Nevada resident and employee of Interstate Distributor Company, was traveling north on Highway 395 transporting merchandise in an Interstate truck when his vehicle struck the Cropps’ parked truck. Interstate is a Washington corporation with its principal office in Tacoma and transacts most of its business in California. Rust works mainly in California but also in other western states, including Oregon about twice monthly. Plaintiffs retained counsel within one month of the accident and began but did not complete filing a lawsuit in Washington. Instead, they filed this action in Oregon in April 1992, more than one year after the accident.
