Crinkley v. Holiday Inns, Inc.

In February 1981, the Crinkleys reserved a room at the Holiday Inn-Concord after being unable to book at a Charlotte Holiday Inn. During the two weeks preceding their stay, a group dubbed the “Motel Bandits” had assaulted and robbed guests at seven Charlotte-area motels. The assistant manager of Holiday Inn-Concord, Brian McRorie, was aware of these incidents through media reports and was contacted by local law enforcement officers who offered security services. McRorie requested additional security from his supervisor Jim Van Over at TRAVCO, but the request was denied. On February 27, 1981, shortly after the Crinkleys arrived at approximately 8:00 p.m., three armed men assaulted them in their room. James Crinkley was severely beaten and suffered a broken jaw. Sarah Crinkley was threatened at gunpoint and robbed of her engagement ring. Both were bound and gagged. Sarah Crinkley, who had preexisting conditions including hypertension and obesity, suffered a heart attack fourteen months later and subsequently required heart bypass surgery. She also developed post-traumatic stress disorder and major affective disorder.
