Sales Keyed to Keating
Crews v. W.A. Brown & Son, Inc.
Citation:
416 S.E.2d 924 (1992)Facts
In mid-1984, Foodcraft Equipment Company sold a walk-in freezer to Calvary Baptist Church. Foodcraft purchased the necessary parts from W.A. Brown & Son, Inc., including a pre-assembled door with a Standard-Keil latch assembly and an interior label stating occupants could not be locked inside. Foodcraft employees assembled the freezer at the church and tested the door latch to ensure it functioned properly, finding no indication of defects. On July 2, 1985, thirteen-year-old Vickie Crews, working as a volunteer registration desk manager at the church, entered the freezer and became trapped when the door closed behind her. Despite her efforts to open the door using the internal release button, frost accumulation in the release mechanism prevented it from functioning. After approximately one hour trapped in the freezer, Crews was discovered suffering from severe frostbite to her feet, legs, and buttocks. She underwent approximately five operations, including amputation of nine and one-half toes. Plaintiffs’ expert testified that frost had accumulated through the seal separating the plastic cover from the metal door due to improper installation.
