The plaintiff visited the defendant’s banquet with her friends. One of the plaintiff’s friends ordered shrimp. When this friend was served shrimp, she was nauseated by the odor, causing her to run to the restroom. The plaintiff followed her friend to provide comfort. Unbeknownst to the plaintiff, her friend had vomited in the restroom. Therefore, when the plaintiff stepped into the restroom she slipped on the vomit, causing her to fall and break her hip. The plaintiff argued that the defendant was negligent for selling unwholesome, deleterious food.
