Cooper v. Aaron
Citation:
358 U.S. 1 (1958)Facts
Following the Supreme Court’s decision in Brown v. Board of Education, the Little Rock School Board developed a gradual desegregation plan beginning with Central High School in 1957. The plan was approved by the federal district court. However, Governor Orval Faubus deployed the Arkansas National Guard to prevent nine African American students from entering the school. After a federal court ordered the removal of the National Guard, the Governor withdrew the troops but a hostile mob gathered. President Eisenhower then dispatched federal troops to ensure the students’ admission. Throughout the 1957-1958 school year, the school experienced significant disruption, violence, and turmoil. In February 1958, citing these conditions, the School Board petitioned the district court to postpone desegregation for 2.5 years. The district court granted this request, but the Court of Appeals reversed, leading to the Supreme Court’s review.
