Iris Cook, a patient of Dr. Bryan Downing, a licensed dentist who devoted less than fifty percent of his practice to fitting and making dentures, sued him in small claims court for mouth problems she attributed to ill-fitting dentures. Cook alleged the condition resulted from poorly fitted dentures. Dr. Downing testified that the condition was generalized and inconsistent with localized sore spots that would result from ill-fitting dentures. He referred Cook to oral surgeons for evaluation. The dental specialists’ evidence indicated they believed the condition was due to candidas, an autoimmune reaction, or an allergy to the dental material. Although none of the dental evidence definitively identified the source of the problem, all dental testimony consistently ruled out ill-fitting dentures as the cause of Cook’s mouth condition.
