Plaintiff filed a civil suit against Defendant for assault and battery and, pursuant to Conn. Gen. Stat. § 52-278e, applied for a prejudgment attachment on Defendant’s home. To support his application, Plaintiff submitted a five-sentence affidavit claiming that he was assaulted by Defendant. A judge found that Plaintiff’s affidavit was supported by probable cause and approved the application for attachment. Defendant filed suit against Plaintiff in federal court, alleging that Conn. Gen. Stat. § 52-278e violated his Due Process rights.
