The Michigan High School Athletic Association (MHSAA) scheduled six girls’ sports during non-traditional seasons, while scheduling all boys’ sports during their traditional seasons. This scheduling practice disadvantaged female athletes in various ways, including reduced collegiate recruiting opportunities, limited ability to participate in club sports, and conflicts with national competitions. The scheduling also resulted in female athletes playing with inferior equipment and in less desirable weather conditions. Communities for Equity, representing female high school athletes, filed suit alleging that MHSAA’s scheduling practices discriminated against girls in violation of Title IX, the Equal Protection Clause, and Michigan state law. The district court found that MHSAA was a state actor and that its scheduling practices violated both Title IX and the Equal Protection Clause.
