The appellants’ convictions stemmed from three separate incidents involving their daughter April when she was between seventeen and twenty-four months old. In summer 1983, witness Ann Marie Blaine observed Debby Ogin grab April by one arm and fling her against a building like “an old rag doll,” causing April to hit cement steps and scream for several minutes, leaving a red mark on her face. In December 1983, at a firehouse Santa visit, Debby twice struck April in the face with the back of her hand with “extreme force” when April reached to be picked up, causing her to fall against a brick wall and sustain a lump on her head. In February 1984, Glynn Wildoner pushed a plate of hot spaghetti into April’s face when she would not eat, causing her face to swell and sustaining burn marks. Both parents denied the incidents and claimed they only disciplined by light spanking or removing toys.
