Laura Crowell sought outpatient treatment at College Hospital in 1990 for agoraphobia and panic disorders. Shortly after treatment began, she met Robert Berry, who worked in the hospital’s cardiopulmonary unit as director of cardiopulmonary services. Berry approached Laura, expressed personal interest in her condition, claimed he had read her chart, and offered to help treat her problems despite not being a psychotherapist. Berry and Laura began socializing outside the hospital, practicing relaxation exercises together, and eventually became sexually intimate while discussing marriage. During this relationship, Berry solicited approximately eight thousand dollars in cash and gifts from Laura. In December 1990, Berry ended the relationship, causing Laura to suffer a breakdown requiring hospitalization at another psychiatric institution. Hospital administrator Ken Westbrook heard third-hand rumors about the relationship in fall 1990, confronted Berry who adamantly denied any contact with Laura, and warned Berry that patient involvement might be perceived as questionable. Laura and her husband Richard filed suit against the Hospital alleging professional negligence, intentional and negligent infliction of emotional distress, and seeking punitive damages.
