Defendant picked up Plaintiff in the evening to attend a party together. The two stopped at a convenience store to pick up a twelve-pack of beer. Witnesses testified as to Defendant’s intoxication earlier in the day, as well as during interaction with Plaintiff, and after the accident. The two had planned to consume alcohol together that evening and drank for several hours together. Plaintiff witnessed Defendant consume alcohol over the course of the evening, and expert testimony established Defendant’s blood-alcohol level was two times the legal limit at the time of the deadly crash.
