Brenda Clinton, a twelve-year-old female, expressed interest in playing football with the 97th Street Bulldogs team in September 1974. Her mother signed the required Medical Service Agreement on September 28, 1974, and Brenda met all requirements of the Cleveland Browns Muny Football Association. On multiple Saturday afternoons, plaintiff was suited and prepared to play but was informed by defendant Charles Hall that she could not participate because she was female. At defendant Maver’s request, Mrs. Clinton signed an additional waiver not required of male participants, absolving the City from liability. Despite representations that signing the waiver would allow Brenda to play on October 19, 1974, Mrs. Clinton was notified on October 18, 1974, that Brenda could not play because “that was the law.” The City’s regulations specifically excluded females from participating in contact sports, and defendants did not dispute that sex was the sole reason for plaintiff’s exclusion.
