Claudio v. State
Citation:
585 A.2d 1278 (1991)Facts
On February 13, 1987, victims Juan Soto and Rafael Lopez were paid by their employers and went to the Spinning Wheel Inn tavern near Kaolin, Pennsylvania, remaining until approximately 1:30 a.m. on February 14. Needing transportation back to Avondale, Pennsylvania, they accepted a ride from defendants Claudio and Maymi in exchange for ten dollars for gas. Instead of driving toward Avondale, Maymi drove toward Delaware, turning onto Centerville Road near Hockessin. There, the defendants demanded money from the victims. Claudio struck and stabbed Soto, who escaped, while Lopez was killed. Detective Downs discovered Lopez’s body and later found Soto at a hospital. Soto provided detailed descriptions of his assailants and identified both defendants from photographic lineups. Police arrested Claudio and Maymi on February 20, 1987. During trial, after deliberations began, one regular juror became ill overnight and was replaced with an alternate who had been separately sequestered. The reconstituted jury deliberated approximately nine and one-half hours before returning guilty verdicts on all charges.
