The City of Norwood, surrounded by Cincinnati, experienced industrial decline and financial difficulties over forty years. Interstate 71 construction in the 1960s significantly altered appellants’ neighborhood, creating traffic, noise, and converting residential areas to commercial use. Rookwood Partners proposed a development requiring over 200 apartments/condominiums and 500,000 square feet of commercial space. Norwood retained consulting firm KKG to study the neighborhood, which concluded it was “deteriorating” though not blighted. Most property owners agreed to sell, but appellants refused. Norwood appropriated their properties after city council adopted ordinances authorizing the taking. The trial court found conflicting evidence about the neighborhood’s condition but determined Norwood had not abused discretion in finding it “deteriorating.” After compensation was deposited, Norwood transferred properties to Rookwood, which began demolishing homes.
