In 2004, the Nuclear Regulatory Commission substantially revised its procedural rules for reactor licensing hearings. The revised rules replaced formal, trial-type procedures with more informal ones, limiting discovery, cross-examination, and other traditional adjudicatory methods. The NRC justified these changes as necessary to streamline the hearing process and make it more efficient while still ensuring meaningful public participation. Citizens Awareness Network and other public interest organizations challenged these revisions, arguing that they violated the hearing requirements of the Atomic Energy Act and the Administrative Procedure Act by eliminating important procedural protections for the public in nuclear licensing proceedings.
