Church of the Lukumi Babalu Aye v. City of Hialeah
Citation:
508 U.S. 520 (1993)Facts
The Santería religion originated in the 19th century when African slaves brought to Cuba combined their traditional Yoruba religion with elements of Roman Catholicism. Animal sacrifice is a principal form of devotion in Santería, performed at various ceremonies including birth, marriage, and death rites. In 1987, the Church of Lukumi Babalu Aye leased land in Hialeah, Florida, and announced plans to establish a place of worship. This announcement prompted significant community opposition. The Hialeah City Council held an emergency public meeting and subsequently passed several ordinances. These ordinances defined “sacrifice” as killing animals in a ritual not primarily for food consumption and prohibited such sacrifices. The ordinances contained exemptions for slaughterhouses, hunting, fishing, euthanasia, pest control, and other secular animal killings. The record revealed that city officials and residents made numerous statements demonstrating hostility toward Santería practices.
