Chicago Title & Trust Co. (Plaintiff) sued First Arlington National Bank (Defendant), seeking (1) restitution of an overpayment mistakenly made from an escrow account, and (2) damages for a misrepresentation made when Plaintiff was applying for a disbursement from the escrow. Arlington Bank agreed to lend $312,000 to a couple who sought to build a manufacturing facility. However, Defendant’s bank records showed that a check was deposited in one of the general contractor’s accounts without notifying Plaintiff of its error.
